A medical panel empanelled by the Nigerian Medical Association (NMA) has concluded that the detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, is fit to stand trial.

The report, ordered by Justice James Omotosho of the Federal High Court, Abuja, stated that the ailment complained about by Kanu is not life-threatening and does not prevent him from continuing with his terrorism trial.


NMA Medical Panel Submits Findings

The NMA medical team was constituted on the directive of the court to ascertain Kanu’s true health condition following conflicting medical reports earlier submitted by experts engaged by both the prosecution and defence teams.

According to the report, which was submitted to the court on October 13 by the prosecution team led by Chief Adegboyega Awomolo (SAN), the panel found no evidence that Kanu’s health posed any immediate or critical danger.

Part of the report, which was read in open court during Thursday’s proceedings, confirmed that the defendant’s health status “is not life threatening.”

The medical experts, therefore, concluded that Kanu is “medically fit to stand trial.”


Court Accepts Report, Orders Continuation of Trial

Justice James Omotosho, after reviewing the panel’s findings, ruled that the court was satisfied with the medical conclusions and saw no reason to delay proceedings further.

“The court is convinced by the report of the Nigerian Medical Association panel that the defendant is fit to stand trial,” Justice Omotosho ruled.

With no objections raised by either party, the court directed that Kanu should proceed with his defence.

The judge subsequently granted the defendant six consecutive days — beginning from October 23 — to open and close his defence in the ongoing terrorism case filed by the Federal Government.


Defence Granted Private Consultation with Kanu

Earlier, the lead defence counsel, Chief Kanu Agabi (SAN), made an oral application requesting that Kanu’s legal team be allowed to hold private consultations with their client outside the premises of the Department of State Services (DSS).

Agabi argued that the defence team feared their discussions with Kanu were being monitored or recorded by security operatives, compromising confidentiality and fair trial rights.

Justice Omotosho granted the request, permitting the defence to hold a private consultation with Kanu inside the courtroom, with only the defendant and his legal representatives present.

According to the court’s directive, the private session will take place on October 22, between 9 a.m. and 12 noon, after which the trial will resume formally on October 23.


Background to the Health Controversy

Kanu’s legal team had, in previous sittings, raised repeated alarms about his deteriorating health while in DSS custody, alleging that he was denied adequate medical care.

The Federal Government, through its legal representatives, disputed the claims, arguing that Kanu was receiving proper treatment and that the defence’s repeated applications were aimed at stalling the trial.

To resolve the conflicting medical narratives, Justice Omotosho ordered an independent assessment by a team appointed by the NMA — a decision both parties agreed to.
